FORECLOSURE DEFENSE:

Simons & Simons, P.A. provides legal representation for individuals and companies that have been served with a foreclosure lawsuit.  We may be able to prevent or delay the bank from taking your home or commercial property. We will review and evaluate the mortgage documents, the note, the bank disclosures, and the manner in which you were served, in order to create a defense plan that meets your specific needs.  If you need  more time to refinance, modify your loan or arrange a short sale, we may be able to obtain that time for you by delaying the foreclosure.

Foreclosure proceedings are hard enough, dealing with the emotions that accompany the thought of losing your home can be very difficult.  Remember that you don’t have to fight the bank alone! If your bank is threatening to foreclose, or even if you've already had papers filed against you, it may not be too late to save your property.  Please be aware that many lenders continue with foreclosure proceedings while negotiating with homeowners.  YOU NEED TO FIGHT FORECLOSURE EVEN IF YOU ARE NEGOTIATING WITH YOUR BANK.

Florida law only gives you a few days to respond to a foreclosure action once you have been served with court papers.  If you delay, the cost of fighting the foreclosure increases while the chances of being successful decrease.  We recommend you contact our office as soon as you are served to avoid a default judgment from being entered against you.

BANKRUPTCY

At Simons & Simons, P.A. we handle Chapter 7 and Chapter 13 bankruptcy cases.  We understand that financial trouble can arise from a number of different situations.  As if the stress of being in hard economic times were not enough, your creditors are probably hitting you with threatening or harassing phone calls. Once you get behind in your credit card payments, the fees and interest rates can increase rapidly, making it difficult to get out of debt.  Bankruptcy can provide you with protection from the harassing phone calls while giving you the chance to make a fresh start financially.  Additionally filing for Bankruptcy can put an end to foreclosure actions, repossession of personal property, and judgments. Please contact us for a free consultation to determine whether or not Bankruptcy is a valid option for you and your family.

Chapter 7
Filing for Chapter 7 Bankruptcy makes it possible to eliminate most of your debt.  Because Chapter 7 is a fresh start and because the system has been abused in the past, there are several requirements a person must meet in order to file for Chapter 7.  By contacting our office we can set up a free consultation to determine if you and your family qualify for Chapter 7.  There are many defenses that become available to a person once they file for bankruptcy.  These regulations are aimed at preventing creditors from contacting you in order to collect on the debt. This means that you won’t have to worry about receiving threatening or harassing phone calls from creditors.

Chapter 13
Chapter 13 for individuals or married couples allows you to make, in many cases, reduced payments on your outstanding bills and set up a repayment plan that you can make over a period of three or five years.  A Chapter 13 case can halt foreclosure proceedings and help clients to become current on their mortgage by adding the arrearage into Chapter 13 plan payments.
